Terms and conditions

1 Introduction

  1. Invenza trading and services, registered in Qatar under Establishment number 17219623 (Invenza trading and services), owns and operates the Owlo mobile application (Owlo App) for renting and trading electric bicycles (e-scooter). E- scooter can only be rented by customers who have registered through the Owlo App.
  2. These Terms and Conditions (Terms) govern how Invenza trading and services provides its services to you. They cover using the Owlo App and e- scooter rental agreements made using the app (Owlo Services).
  3. Please read these Terms carefully. They explain how Invenza trading and services offers its services, how to enter or end a rental agreement, what to do in case of problems, and other important information.

2 Invenza trading and services Information and Contact

  1. Invenza trading and services registered office is at AlRefaa Tower, Zone 17 Street 830 Building 54, Doha, Qatar. Its Establishment number is 17219623.

3 These Terms

  1. These Terms govern using the Owlo App and e- scooooter rental agreements made via the Owlo App.
  2. Special Terms may apply depending on the city where Owlo Services are offered due to specific local conditions (Special Terms). These Special Terms will be attached as an Appendix to these Terms.
  3. Invenza trading and servicesreserves the right to amend these Terms as needed due to legal requirements or technological changes. Invenza trading and services will inform you by email of any such changes. Any changes will be considered approved unless you object in writing within six weeks of notification. Eltokhy for trading and renting electrical bicycles will inform you of your right to object when notifying you of changes.

4 Using the Owlo App

  1. To rent an Invenza trading and services e- scooter, you must first register as a customer by creating a user account in the Owlo App. Each customer can register only once. Only registered customers can use Owlo Services. Invenza trading and services has no automatic obligation to register you.
  2. Upon successful completion of the registration process, where you’ll be asked to accept these Terms and provide your full name, email address, phone number, and valid payment details, you’ll enter a User Agreement with Invenza trading and services app use. Invenza trading and services will securely store and retain the User Agreement on its servers. A copy will be sent to you by email.
  3. After registration, you can rent e- scooter by entering individual rental agreements based on these Terms. The User Agreement alone does not grant you the right to rent an e- scooter.
  4. EInvenza trading and services may refuse a User Agreement or rental agreement if it reasonably believes the individual will not comply with these Terms.

5 User Account

  1. You must be the named holder of the bank account or credit card details you provide to Invenza trading and services. You are obligated to keep your registration information updated, including email address, phone number, and payment details.
  2. You cannot allow third parties to use an Invenza trading and services e- scooter booked through your account or share your login details. You must:
    • Change your password immediately if you believe someone else knows it.
    • Notify Invenza trading and services promptly of any lost or stolen phone associated with your account or any circumstances suggesting unauthorized use.
  3. To use the Owlo App, you need a web-enabled phone meeting the app’s technical requirement. The app will automatically check your phone’s compatibility during download. You are responsible for ensuring mobile data communication and any associated charges from your mobile service provider.
  4. You are prohibited from using information technology methods to read, copy, or manipulate the Owlo App. If you breach or attempt to breach this prohibition, Invenza trading and services has the right to withdraw your app access immediately without prejudice to any other legal remedies.
  5. You must inform Invenza trading and services promptly of any lost or stolen phone associated with your user account or any circumstances suggesting unauthorized use. Invenza trading and services will disable access until the situation is resolved and inform you by email.

6 Reserving an E-Scooter and Starting a Ride

  1. E-Scooter rentals are subject to availability within a designated service area (Service Area).
  2. You can only rent e- scooter designated as available in the Owlo App. Be aware that occasional GPS inaccuracies may cause slight deviations between an e- scooter’s actual location and the app display.
  3. You can reserve a specific Invenza trading and services e-Scooter for a limited time, as defined by Invenza trading and services, before your ride begins.
  4. Clicking “Start Ride” in the Owlo App constitutes a binding offer to rent the reserved e- Scooter. Invenza trading and services accepts this offer by unlocking the e- Scooter for your ride.

7 Ending Your Ride

  1. Your e- Scooter rental ends when you properly park and lock the e- Scooter within a designated Eltokhy for trading and renting electrical bicycles parking zone, as shown in the Owlo App. Ending a ride outside a designated zone may incur additional fees as outlined in § 9 Fees.
  2. Invenza trading and services reserves the right to charge a fee if the e- Scooters not returned within a reasonable time after the ride is ended according to § 7.1.

8 Safe and Legal Use

  1. You are responsible for complying with all applicable traffic laws and regulations while riding an Invenza trading and services e-Scooter. This includes, but is not limited to, wearing a helmet, obeying traffic signals, and not riding under the influence of alcohol or drugs.
  2. You are liable for any damage caused to the e- Scooterduring your rental period due to your negligence or misuse.
  3. Invenza trading and services e- Scooter are intended for single-rider use only. Carrying additional passengers is strictly prohibited.

9 Fees

  1. You agree to pay the rental fees displayed in the Owlo App before starting your ride. These fees may vary depending on the rental duration and other factors.
  2. You are also responsible for any additional fees incurred during your rental period, such as late return fees or parking zone violation fees (as outlined in § 7.2).
  3. Invenza trading and services reserves the right to change its fee structure at any time upon reasonable notice to you.

10 Termination

  1. Invenza trading and services may terminate your access to the Owlo App and its services for breach of these Terms or for any other reason it deems appropriate. In such cases, Invenza trading and services may also pursue any other legal remedies available to it.
  2. You may terminate your User Agreement with Invenza trading and services at any time by following the instructions in the Owlo App. However, you will still be responsible for any outstanding fees.

11 Rider Eligibility

  1. To rent an Invenza trading and services e-scooter, you must: (a) Be at least 18 years old. (b) Have a valid user account with the Owlo App.
  2. You must be capable of riding an e- scooter safely without endangering pedestrians, traffic, or yourself. This includes experience or basic skills in operating a motorized vehicle and familiarity with e-bike operation and safety.

12 Your Responsibilities

  1. Treat Invenza trading and services e- scooter with care, follow traffic regulations, and avoid any actions that may harm yourself or others. You acknowledge potential liability for injuries or damage caused by your e-bike use.
  2. You must specifically: (a) Comply with the maximum weight limit of 100 kg (220 lbs). (b) Wear a helmet as required by local traffic regulations. (c) Follow any COVID-19 regulations issued by the World Health Organization and local authorities. (d) Not leave the e- scooter unattended during the rental period. (e) Report any defects or damage (especially from accidents) to Eltokhy for trading and renting electrical bicycles immediately. (f) Ensure, as reasonably possible, that the e- scooter is safe to operate for yourself and others. (g) Obey all traffic regulations while riding. (h) Stop the e- scooter if a warning light appears or an error signal display. Contact Invenza trading and services for further guidance. (i) Park the e- scooter properly within designated Eltokhy for trading and renting electrical bicycles parking zones (as shown in the Owlo App). (j) Pay any applicable fees if you return the e- scooter outside the designated Service Area (as defined in § 6).
  3. You are prohibited from: (a) Riding under the influence of alcohol, drugs, or medications that impair your ability to ride (0.0% blood alcohol content is strictly enforced). (b) Using the e- scooter for off-roading, motorsports, or racing. (c) Using the e- scooter for driver training, commercial passenger transport, or other commercial purposes (e.g., deliveries). (d) Transporting flammable, toxic, or hazardous materials exceeding normal household quantities. (e) Transporting objects that could compromise riding safety or damage the e- scooter due to size, weight, or shape. (f) Riding with additional passengers. (g) Using the e- scooter for criminal activity. (h) Performing unauthorized repairs or modifications to the e-bike. (i) Using mobile devices while riding (including music players, phone calls, or any activity that distracts you or hinders safe operation).
  4. Invenza trading and services encourages environmentally friendly and responsible riding practices. Please avoid wasteful electricity consumption and maintain a courteous riding style.

13 Accidents

  1. Report any e- scooter accidents to Invenza trading and services immediately.
  2. Contact the police promptly after an accident and ensure they officially record it. If this is not possible, notify Invenza trading and services and coordinate further steps. This applies regardless of fault. You must not leave the scene until: (a) The police have completed their report (or Eltokhy for trading and renting electrical bicycles has been notified if a police report is unavailable). (b) Any necessary evidence collection or damage mitigation measures coordinated with Eltokhy for trading and renting electrical bicycles are implemented.
  3. Do not admit liability or make similar statements following an accident. Any such actions will apply solely to you and not Invenza trading and services or its insurers.
  4. Invenza trading and services will provide an accident report form, which you must complete and return within seven days. Failure to return the form by the deadline may affect your insurance coverage.
  5. You are obligated to provide truthful information about the accident location and comply with all applicable laws and regulations.

14 GPS (Global Positioning System)

  1. Invenza trading and services e-Scooters are equipped with GPS to enable us to locate them at any time.
  2. The purpose of the GPS is to deter theft, identify and prevent criminal activity, and analyze e- Scooter performance.
  3. Invenza trading and services also uses electronic devices and systems to monitor e- Scooter status, operation, and movement.
  4. Information gathered through these systems may be used during and after your rental to ensure service execution, compliance, and performance analysis.

15 Insurance

  1. Invenza trading and services e- Scooter are covered by third-party liability insurance in Qatar.
  2. You are prohibited from admitting or settling any damage covered by this insurance without Invenza trading and services prior consent.

16 Invenza trading and services Liability

  1. Invenza trading and services is liable for the foreseeable loss or damage caused by us. If we fail to comply with these Terms, we are responsible for foreseeable losses or damage you suffer as a result. Loss or damage is foreseeable if it’s obvious or if both parties could reasonably anticipate it when the agreement was made.
  2. Invenza trading and services does not exclude or limit its liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our gross negligence or the gross negligence of our employees, agents, or subcontractors.
  3. Invenza trading and services is not liable for business losses. Invenza trading and services e- Scooter are provided for private use only. If you use our services for any commercial or business purpose, Invenza trading and services will not be liable for any loss of profit, business interruption, or loss of business opportunity.

17 Your Liability

  1. You are liable to Invenza trading and services for any damages you cause, including theft, damage, or loss of an e- Scooter. Invenza trading and services entitled to be indemnified by you for any legitimate third-party claims (including legal costs) not covered by your personal insurance.
  2. You are liable for all traffic regulations, public order regulation, and other statutory provision violations for which you are responsible while using an e- Scooter. You are also liable for any resulting penalties, fees, and costs and must indemnify Eltokhy for trading and renting electrical bicycles for any resulting third-party claims. You are not liable if penalties, fees, or claims result from using a defective e- Scooter in accordance with these Terms.
  3. Invenza trading and services reserves the right to identify you to the authorities in case of traffic regulation breaches during your rental (e.g., traffic offenses and illegal parking).
  4. Invenza trading and services may recover costs of any infringements you commit, such as fines, penalties, and legal expenses paid by Invenza trading and services. These payments will be made through your user account payment methods. Invenza trading and services may also charge fees displayed in the Owlo App.
  5. Failure to pay any owed amounts may result in immediate termination of your contract with Eltokhy for trading and renting electrical bicycles. Eltokhy for trading and renting electrical bicycles reserves the right to take further legal action to claim damages and losses.
  6. You are not liable to the extent that an insurer compensates the damage, and no recourse is taken against Eltokhy for trading and renting electrical bicycles.
  7. The limitations of liability agreed between Invenza trading and services and you regarding e- Scooter damage will not apply if you willfully caused the damage.

18 Temporary Disabling of User Accounts and Exclusion from Use

  1. Invenza trading and services may temporarily disable your user account access if: (a) Incorrect data is provided in your user account. (b) You default on payments exceeding a negligible amount despite receiving notice. (c) There are other significant contractual breaches for which you are responsible. (d) You lose or have your phone stolen associated with your user account, or it becomes possible for unauthorized use.
  2. Invenza trading and services will unblock your user account promptly once the reason for suspension is resolved.
  3. Invenza trading and services may prevent your further use of e- Scooter if you repeatedly breach these Terms and fail to respond to a warning letter.

§ 19 Term and Termination of the User Agreement

  1. The User Agreement is for an indefinite period and may be terminated by either party with written notice two weeks before the end of any calendar month.
  2. Either party may terminate for cause with immediate effect, without a court order. Invenza trading and services may terminate the User Agreement immediately without a court order if: (a) You repeatedly default on payments owed to Invenza trading and services despite being notified. (b) You provide incorrect information or conceal facts during registration or your contractual relationship with Invenza trading and services, making it unreasonable for Invenza trading and services to continue the relationship. (c) You fail to stop serious breaches of these Terms after a warning letter or fail to correct existing consequences

§ 20 Governing Law and Dispute Resolution

  1. This User Agreement and individual rental contracts are governed by and construed in accordance with the laws of Qatar. The courts of Qatar shall have exclusive jurisdiction over any disputes arising out of or in connection with these agreements.

21 Marketing and User Content

  1. You grant Invenza trading and services a non-exclusive, royalty-free, worldwide license to use, reproduce, modify, publish, and translate any content you create or submit through Owlo App, including but not limited to photos and videos (collectively, “User Content”). This license allows Invenza trading and services to use your User Content for marketing and promotional purposes, such as on our website, social media channels, and advertising materials.
  2. You represent and warrant that you own all rights to your User Content, or that you have obtained all necessary permissions and licenses to grant Eltokhy for trading and renting electrical bicycles the rights set forth in this Section 19.
  3. You acknowledge and agree that Invenza trading and services may edit or modify your User Content at its sole discretion for marketing purposes.
  4. You can revoke your consent for Invenza trading and services to use your User Content at any time by contacting us through the app or at support@owlomobility.com However, Invenza trading and services reserves the right to retain and use any User Content for which we have already obtained permission.

22 Additional Terms

  1. Assignment: You may not assign your rights or obligations under this User Agreement to any third party without Eltokhy for trading and renting electrical bicycles prior written consent. EInvenza trading and services may assign its rights and obligations under this User Agreement to another company or legal entity, and you hereby agree to such assignment without objection.
  2. Waiver: Invenza trading and services failure to insist on strict performance of any provision of this User Agreement will not be construed as a waiver of any subsequent or prior breach of that provision or any other provision of this User Agreement.
  3. Severability: If any provision of this User Agreement is held by a court of competent jurisdiction to be invalid or unenforceable, such provision shall be struck from this User Agreement and the remaining provisions shall remain in full force and effect.
  4. Entire Agreement: This User Agreement constitutes the entire agreement between you and Eltokhy for trading and renting electrical bicycles concerning the subject matter hereof and supersedes all prior or contemporaneous communications, representations, or agreements, whether oral or written.
